Geographical indications (GIs) are an important aspect of protecting traditional products that are linked to specific regions. In Bulgaria, GIs are registered and protected under the Law on Trademarks and Geographical Indications (ZMGO). These designations identify products whose qualities or reputations are closely associated with their geographical origin.
Examples of geographical indications in Bulgaria include:
- Bulgarian Rose Oil: Produced in the Rose Valley around Kazanlak and Karlovo, renowned globally for its quality and unique properties.
- Bulgarian Yogurt: Known for its distinctive Lactobacillus bulgaricus bacterium, which is native to the region.
- Gornooryahovki Sujuk: A traditional dry sausage from the town of Gorna Oryahovitsa.
- Panagyurska Lukanka: A traditional delicacy from the Panagyurishte region.
- Troyan Plum Brandy: A traditional alcoholic product made in the Troyan region.
- Strandja Honey: A unique type of honey produced in the Strandja region.
These products, and others like them, are protected against the misuse of their names by manufacturers outside their designated regions or those who fail to meet specific production standards.
Registration of Geographical Indications
To be registered as a geographical indication, a product must meet specific criteria, with its geographical origin playing a critical role in shaping its characteristics. In Bulgaria, geographical indications are registered through the Patent Office. The registration process requires submitting an application that includes a description of the product, the geographical region, the production methods, and proof of the link between the product and the region. Once approved, the product receives legal protection, preventing unauthorized use of the geographical indication by other manufacturers.
Protection from Competitors
The Law on Trademarks and Geographical Indications offers legal protection against unfair competition, prohibiting other producers from using a registered geographical indication unless their products meet the required standards and originate from the designated region. Violations of these rights can result in lawsuits and penalties.
Protecting geographical indications not only helps preserve the uniqueness and quality of traditional products but also supports the economic development of the regions where these products are made. Registering a geographical indication gives manufacturers a legal tool to defend against competition and safeguard their commercial interests.
