The classification of outsourcing by geographic location is a key factor in determining the operating model and risk levels for an organization. 

The choice between a local or international partner directly affects communication, the legal framework, and the protection of company assets.

  • Onshoring: the contractor is located in the same country, which facilitates personal meetings, removes language barriers and ensures work in the same legal and tax environment.

  • Detailed intellectual property (IP) clauses: The contract must clearly state that any innovation, code, design, or product created during outsourcing is the exclusive property of the contracting authority.
  • „Assignment of Rights“ Clauses: It is mandatory to include texts that automatically transfer all copyrights on the results of the work from the contractor to your company, without the need for additional actions.
  • Restrictions on working with competitors: a ban on the outsourcing company providing identical services for developing similar products to your direct competitors for a certain period of time.
