Trademark registration
August 13, 2024

A trademark is a sign that distinguishes the goods or services of a business from those of its competitors. Protectable symbols can be words, letters, numbers, drawings, shapes, colors, sounds, or various combinations thereof.

Verbal trademarks – consist of one or more words or letters (names, words, slogans, abbreviations, etc.);

Figurative trademarks – can include various types of images (logos, photos, emblems, etc.)

Combined trademarks – include verbal and figurative elements, with protection covering their entirety (the most common form, for example, a combination of a logo and a word);

Three-dimensional trademarks – represent different types of packaging (boxes, bottles, etc.);

Positional trademarks – consist of the way in which the brand is attached or placed on the product;

Sound trademarks – represent a certain melody or combination of sounds;

Colored trademarks – composed of a single color or a combination of colors;

Others trademarks – fragrances, motif marks, motion marks, multimedia and hologram marks.Others trademarks – fragrances, motif marks, motion marks, multimedia marks, hologram marks.

A trademark distinguishes the goods or services offered by your company from those of your competitors, making your business recognizable in the market. The purpose of registration is to protect you from unscrupulous individuals who may use the trademark in a way that damages your company's image and, last but not least, it provides multiple mechanisms for protection (civil, administrative and criminal).

Successful and valid registration restricts third parties from using the trademark, i.e. no one can use it in any way without your consent, incl. to advertise their own goods and services. The registered trademark is an intangible asset of the company, which is accounted for. The brand can also be the subject of commercial transactions - to be rented, licensed, transferred, pledged, etc.
